North Palm Beach, Palm Beach Gardens trying to annex same properties

PALM BEACH COUNTY, Fla. — Several homeowners in unincorporated Palm Beach County could be annexed by two local governments in 2024.The city of Palm Beach Gardens and the village of North Palm Beach are trying to annex four different communities in unincorporated Palm Beach County. North Palm Beach's Village Manager Chuck Huff said the town decided after Palm Beach Gardens released its plans to annex five zones ...

PALM BEACH COUNTY, Fla. — Several homeowners in unincorporated Palm Beach County could be annexed by two local governments in 2024.

The city of Palm Beach Gardens and the village of North Palm Beach are trying to annex four different communities in unincorporated Palm Beach County. North Palm Beach's Village Manager Chuck Huff said the town decided after Palm Beach Gardens released its plans to annex five zones in October.

Voters in the communities will cast ballots for their preferences in the March 19 election. Palm Beach Gardens has 59,449 residents and North Palm Beach 13,103, according to U.S. Census data.

"Gardens has taken the opportunity to start annexing everything and we're just responding with our rights for future annexation," Huff said.

He also said it’s looked at adding these areas into its village for years in previous comprehensive plans and it's just trying to offer people an additional choice.

WPTV contacted multiple people within the city of Palm Beach Gardens but didn't hear back by publication.

Palm Beach Gardens said the growth would allow it to lower people's tax rates because its tax base would increase from the acquisition, according to WPTV reporting. Palm Beach Gardens said it has annexed nine areas over the past five years as property values are increasing across Palm Beach County.

Any potential annexation wouldn't become official unless people within those areas vote to join the city, according to city staff. Each area would have its own vote and a 50% plus one majority would be required to join a community.

Celeste and John Colliton live in Hidden Key, one of the four communities the two governments are competing to add within their city limits. Their votes will count in two jurisdictions, which means they could get added into both communities, one community or none.

Celeste said she's currently against joining any community because she doesn't understand the benefits of joining a community. She's also said she's frustrated her home is grouped within a jurisdiction of about 7,600 people for the vote to join Palm Beach Gardens.

"It's just frustrating because they say, 'You can just vote no,'" Celeste said. "...But, our vote is not going to vote when you group us with all these other homes."

The Collitons are also concerned about the potential costs of possibly joining a community requiring a connection to a sewer system rather than a septic tank.

WPTV reporter Ethan Stein saw signs urging people to vote "No" throughout their community Monday. Palm Beach County commissioners will get an opportunity to voice their opinion on the annexation Tuesday at their board meeting.

The town of Loxahatchee Groves and the village of Wellington are also in a dispute related to Wellington's efforts to annex land north of Southern Boulevard, according to a letter WPTV obtained.

Jim Barnes, who is Wellington village manager, said the village was approached by property owners or their representatives about the feasibility of joining Wellington. He said the village believes it's the best suited to serve property owners.

"We believe we are best suited to serve the property owners and future residents of the subject annexation area should they elect to annex into a municipality," Barnes said in an email. "In many cases, we already serve as a main service provider for many residents in the mid-western communities, both in municipal limits and unincorporated areas due to our location, programs, and services."

Francine Ramagila, the town manager for Loxahatchee Groves, said Wellington's plan is "detrimental" to Loxahatchee Groves. She said it would conflict with the town's rural character due to increased density and intensity.

NORTH PALM BEACH — Three North Palm Beach Village Council members have resigned over a new state law that takes effect in January that will require elected officials of municipalities to disclose their personal finances in a document called “Form 6.”

Council member Darryl Aubrey announced his departure during a meeting on Wednesday, Nov. 15. He served 17 years on the council.

Mayor David Norris, who served a total of 27 years, and council member Mark Mullinix, who served eight, followed. They announced their resignations during the council’s meeting on Thursday, Dec. 14.

Village Manager Chuck Huff said that Form 6 is detailed and will require council members to disclose the exact numbers in their bank accounts, 401(k) plans and personal assets. It targets Florida’s smaller municipalities, since many larger cities and towns already require significant amounts of financial disclosure.

“Some of the (disclosures) are just really too much for municipal bodies,” Huff said.

The remaining council members, Susan Bickel and Deborah Searcy, appointed Karen Marcus on Thursday, Dec. 14, to fill one of the empty council seats until three new council members are elected on Tuesday, March 19. Marcus, a longtime North Palm Beach resident, served as a Palm Beach County commissioner from 1984 to 2012.

The current council members plan to appoint two more people to fill the other vacant seats during a special meeting at 4 p.m. Thursday, Dec. 21. The council will then choose a mayor to serve through March.

Norris broke into tears when he announced his resignation. He said he hoped to serve another term, but had to resign as his business does not allow him to do such disclosures. Norris is a partner at a law firm with offices in the village and Boca Raton.

“I think the new rule is ridiculous and wrong,” Norris said on Dec. 14. “It’s something I can’t do. That is forcing me to do something that I don’t want to do, so I am announcing my resignation.”

Mullinix said he would even have to disclose his daughter’s college fund on Form 6, which he said he “couldn’t fathom” doing.

“What the state has done has made it impossible for me to stay,” Mullinix said at the meeting. “This has been one of the great honors of my life and it's been a treat to serve in my hometown.”

North Palm Beach to fill David Norris' seat in March 19 election

Once the new members are elected, the council will elect a mayor from among themselves at the first meeting following the election. Two people each are running to fill the seats formerly held by Mullinix and Aubrey.

A separate election qualifying period will be held from Jan. 4 to 11 to fill Norris’ former seat. Village voters will cast ballots on his replacement March 19.

“(The resignations) were kind of heartbreaking,” Huff said. “But it did not surprise me. Form 6 has a lot of people spooked and we are not the only municipality that is going through this.”

Elected officials in Dunnellon, Windermere, Longboat Key and other South Florida municipalities have resigned over the new requirement, according to media reports.

North Palm Beach swore in interim council member and former mayor Jody Pierman Thursday to fill one of three new vacancies on the council, connected to the enactment of a new statewide financial disclosure form.

The vacancies weren’t expected.

Mayor David Norris tearfully told the town last week his law firm can’t allow him to make public financial disclosures like the one the new Form 6 law requires.

"That is forcing me to do something that I – don’t want to do," Norris said.

After 27 years on the council in the town he grew up in, Norris reluctantly says it's over.

"So I am announcing my resignation as councilor and as mayor, effective tomorrow and today," Norris said.

Another council member resigned over the disclosure requirements last month, and after Norris received a standing ovation — council member Mark Mullinix said he was stepping down too.

"What the state has done has made it impossible for me to stay as well," Mullinix said.

It’s a scene playing out in smaller towns across the state.

The detailed new forms require council members to reveal exactly how much money they have in all their accounts, their 401(k) plans, all their debts, their income sources and their assets.

"I think it's ridiculous, frankly, I think it's wrong; whether I’m right or wrong, it doesn’t matter; it's something I can’t do," said Norris, who is a partner in a law firm that doesn't allow such disclosures about its clients and finances.

Former county commissioner Karen Marcus was sworn in as a temporary replacement last week.

One nominee for an interim position questioned whether he would also have to fill out the form; when the village attorney said he thinks so, that nominee declined to serve.

Villagers will elect permanent council members in the March election.

According to published reports, at least two dozen council members in 11 Palm Beach County towns have resigned.

The village council approved a 4-acre plot of land on the corner of U.S. 1 and Yacht Club Drive for a mixed-use development that will include apartments, some of which will be workforce housing.

Village manager, Chuck Huff says the project is something the village has been talking about for a while.

“It's been in the process for several years," said Huff. “Overall, the architecture of the property is really good. And we're glad we've gotten over the hump”

The complex will feature 147 apartments, 24 of which will be workforce housing, and three units will have adjoining office space meant for small business owners.

Huff says he’s excited to see the current empty property turn into something that will help build up the community.

“We want businesses to come in there that is going to draw the community to it. You know, whether it's a bike or the golf cart via, you know, pedestrian walking," said Huff.

According to the plan, there will also be 400 square feet of outdoor restaurant seating along with a single-level parking deck and pool.

Right now, it hasn’t been decided if these units will be for sale or rent, but Huff hopes the project will draw people to stay in North Palm Beach.

“They've been in discussions to where it could be condominiums, which is fine as well. And probably that's what we prefer, you know because you don't have the transient nature of rental," said Huff.

Right now, there is no word on how much these apartments will cost, but officials say the workforce housing will be at below-market prices.

Huff says the next step is finalizing construction plans which will take several months, but he expects construction on the project to start this summer.
